A ATUAÇÃO DO ASSISTENTE SOCIAL COM O ADOLESCENTE PRIVADO DE LIBERDADE: ESPAÇO SOCIOJURÍDICO E SUA INTERFACE COM A POLÍTICA DE ASSISTÊNCIA SOCIAL GOIÂNIA, DE 2011 A MAIO DE 2014.

Abstract

This study researched the procedure of the social assistant with the adolescent in deprivation of freedom in the context of the Política de Assistência Social (Social Assistant Policy) in its interface with the socio-judiciary system, based on the Lei Federal (Federal Law) nº 12.594 (BRASIL, 2012), that establishes the Sistema Nacional Socioeducativo (Socio-Educational National System) Sinasi, instrument that regulates and guides the fulfillment of the socio-educational measures. The research, in quantitative and qualitative approach, apprehended the object in question starting from the investigation of the guarantees of the rights of children and adolescents and the profession of Social Service in the Brazilian capitalist society, revealing the reality as a fullness when unraveling its contradictions and recognizing that it is constituted by mediations, processes and structures. The research also sought the contribution of Iamamoto (2013) and Rizzini (2004), who direct the theoretic grounding of the historic-professional path of the social assistant and the juvenile population. On the other hand the field research was developed guided by a interview script, on the period of April through May of 2014, with eight social assistants that operate in the three Unidades Socioeducativas USEs (Socio-educational Unities) of the city of Goiânia: Centro de Atendimento Socioeducativo Case (Socioeducational Care Centre), Centro de Internação de Adolescentes CIA (Adolescent s Hospitalization Centre), Centro de Internação Provisória CIP (Provisory Hospitalization Centre). It was concluded, therefore, that the referred unities compose the socio-occupational space of the social assistant and presents contradictions and dualities, in a tendency of the Código Menorista (Menorista Code), in detriment of the doctrine of the full protection. Thereby, the performance of the social assistant at the socio-educational unities of Goiânia can be apprehended as a process that demands reflections over the proposed goals and the conditions so they can be achieved, considering the interface established with the Política de Assistência Social (Social Assistant s Policy) and the sociojuridical system in its legal regulations. The research also questions about the politialinsitutional boundaries put in performance of the social assistant with the adolescent in measure of hospitalization for effectuation of the Sistema de Garantia de Direitos (Warranty Rights System). We, then, can conclude that the professionals show the weakness of the professional work in function of the precarious conditions of the socioeducational system, the overcrowding, the sparing investment in the socio-educational care, the insufficient quantity of financial, human and materials resources, inadequate physical structure and non-consistent with the foreseen on Sinase (BRASIL, 2012), among others.
