| Resumo: | A presente pesquisa versa sobre a temática da dignidade humana como direito ao desenvolvimento da criança e do adolescente em conflito com a lei no município de Rio Verde/GO. Tendo como ponto de partida a reflexão, sobre o marco jurídico internacional em relação ao menor e a história do direito penal do menor no ordenamento jurídico pátrio, discorrendo sobre a doutrina do direito penal do menor, a doutrina da situação irregular do menor e doutrina da proteção integral, bem como traça paralelo sobre a teoria da punição e da ressocialização. Num segundo momento, trata-se dos direitos fundamentais das crianças e dos adolescentes sobre a perspectiva constitucional, fazendo análise sobre o direito à garantia de uma existência digna, com o mínimo existencial, conforme previsão da Carta Magna Brasileira. Principalmente no tocante ao direito ao prescrito no art. 227 da CF/88 e ratificado no Estatuto da Criança e do Adolescente de 1990. E em terceiro momento - último capítulo - busca-se responder se a crescente violência praticada por menores no município de Rio Verde/GO tem correlação com a inobservância aos direitos fundamentais da criança e do adolescente. Na busca pela resposta a problemática central, privilegiou-se como metodologia a pesquisa bibliográfica (literatura estrangeira e nacional); pesquisa a doutrina e legislação pátria, bem como a artigos, a sites e a periódicos que tratam do tema, objetivando evidenciar as causas mais comuns que levam o adolescente a prática de atos infracionais no município pesquisado. Teve a presente pesquisa, como alicerce, a análise dos processos de ato infracional em trâmite no Juizado da Infância e da Juventude da Comarca de Rio Verde, no período de janeiro de 2016 a maio de 2016, nos quais o Núcleo de Prática Jurídica da Faculdade de Direito da Universidade de Rio Verde, fez a defesa dos adolescentes que respondem pelos atos infracionais (anexos). A teoria jurídica e sociológica está abalizada, em Ingo Wolfgang Scarlet (2015), Irene Rizzini (2011), Luís Roberto Barroso (2013), Michel Foulcault (2010), Richard Sennett (2012) e Zygmunt Bauman (2001). Todavia, o referencial teórico não se encerra no marco teórico aqui elencado, posto que demais juristas que tratam de temáticas adolescentes em conflito com a lei e direitos fundamentais, foram inseridos no presente estudo para melhor compreensão do tema. |
| Abstract: | This research deals with the theme of human dignity as a right to development of children and adolescents in conflict with the law in the city of Rio Verde/GO. Taking as a starting point the reflection on the international legal framework in relation to the child and the history of criminal law of the juvenile in the Brazilian legal system, discussing the doctrine of criminal law of the juvenile, the doctrine of the minor irregular situation and doctrine full protection as well as parallel traces on the theory of punishment and rehabilitation. Secondly, this concerns the fundamental rights of children and adolescents on the constitutional perspective, making analysis on the right to guarantee a dignified existence, with the existential minimum, as established the Magna Brazilian Charter. Particularly as regards the right to the requirements of article 227 of CF/88 and ratified by the Statute of Children and Adolescents 1990. And in a third moment - the last chapter - seeks to respond to the growing youth violence in the city of Rio Verde / GO correlates with failure to comply with the fundamental rights of children and adolescents. In the search for the answer to the central problem, was favored the bibliographic research (foreign and national literature); the search to doctrine and Brazilian legislation, as well as articles, the websites and periodicals dealing with the issue, aiming to highlight the most common causes that lead adolescents to practice of illegal acts in the county searched. This research took as the foundation, the analysis of infraction proceedings pending the Court of Childhood and Youth of Rio Verde County from January 2016 to May 2016 in which the Legal Practice Center of Faculty of Law, University of Rio Verde, made the defense of adolescents who are liable for illegal acts (attached). The legal theory and sociological is based on Ingo Wolfgang Scarlet (2015), Irene Rizzini (2011), Luis Roberto Barroso (2013), Michel Foucault (2010), Richard Sennett (2012) and Zygmunt Bauman (2001). However, the theoretical framework is not restricted to the theoretical framework here listed, since other lawyers that deal with the themes of adolescents in conflict with the law and fundamental rights were entered in this study to better understand the topic. |
