DIREITO E LITERATURA: COMPARTILHAMENTO HERMENÊUTICO DA DIGNIDADE HUMANA EM VIDAS SECAS, DE GRACILIANO RAMOS

Abstract

This work intends to discuss the interface between law knowledge and literature through the composition Vidas Secas, by Graciliano Ramos, analyzing how the principle of human dignity in this narrative, starting from the problem of the dialogical interrelationship between the legal text and the literature. One of the relevant aspects is the demonstration that the work of art serves as an analytical support for the understanding of Law. The method used is hermeneutic because it treats art as a phenomenon of understanding and understanding of human dignity as a shared concept in Law and Literature. The Law and Literature movement is able to sharpen the sense of otherness and the sensitivity of the jurist, making him a better professional in tune with his social reality, and, therefore, Literature is an auxiliary method in juridical interpretation. The importance of language as an instrument of communication and relationship between social groups is analyzed, reflecting on the constitution of language, deepening the hermeneutic roots of the human experience in general, Law and Literature in particular, made, above all, from the considerations of Gadamer. In the perspective of law, in the work investigated, literature fulfills the role of witness of social reality and legal reality. As a methodological orientation, the present study is developed through bibliographical research and a critical hermeneutic-phenomenological approach, in order to establish the relationship between law and literature, based on Gadamer, Heidegger and Hannah Arendt.
