| Resumo: | A presente investigação insere-se na Linha de Pesquisa “Teorias da Educação” do Programa de Pós Graduação em Educação da Pontifícia Universidade Católica de Goiás. O objeto de estudo trata da discussão sobre a contribuição da educação para o processo de reintegração social do egresso penal, apresentado as abordagens características sobre a aplicação do método APAC, instituído oficialmente no sistema penitenciário do Estado de Minas Gerias. Método este que ganha destaque nacional e internacional (Grossi: 2020) como objeto de estudo científico, em razão dos resultados alcançados na gestão penitenciária com fundamento na humanização da pena. Como problema principal questiona-se o lugar da educação aplicado ao instituto de remição penal pelo estudo previsto na Lei de Execução Penal (BRASIL: 1984), com vistas à viabilizar o processo de reintegração social do egresso penal. Na tentativa de aprofundar o problema levantado, o objetivo geral do trabalho é demonstrar a relação entre o sistema de execução penal, o instituto da remição penal pelo estudo e as teorias pedagógicas da educação; como objetivos específicos: Estudar a evolução histórica das dimensões dos direitos fundamentais que constituíram a consagração direito à dignidade da pessoa humana, e sua relação com Execução Penal. Demonstrar síntese histórica da constitucionalização do direito à educação, relacionando-o com o instituto da remição penal pelo estudo. Apresentar o Método APAC de gestão carcerária, seus fundamentos, finalidades e sua inserção no Plano Estadual de Educação de Minas Gerais. Discorrer sobre as teorias de fundamentos da educação. Apontar a inexistência do Método APAC no Estado de Goiás, para, ao final demonstrar, por meio da pesquisa documental e bibliográfica, a contribuição da educação e sua relação com o método APAC. Para construção do trabalho utilizou-se a revisão da literatura sobre a temática dos direitos fundamentais, utilizando referencial teórico correlato, como destaque: a) o direito fundamental à educação e a dignidade da pessoal humana em Sarlet (2006), Carvalho (2008) e Silva (1999); b) A evolução histórica do sistema punitivo estatal sob escólio de Foucault (2004), Beccaria (1999), e Goffman (2015); c) Evolução histórica da normas constitucionais que regularam a educação em Ribeiro (2009) e Piletti (2010) e sua relação com o sistema de execução penal, tem como plataforma o ordenamento jurídico vigente e a visão de Torres (2019), Grossi (2020) e Alberto (2021); e d) Contribuições do método APAC no sistema penitenciário do Estado de Minas (MINAS GERAIS, 2016), Ottoboni e Ferreira (2016), Grossi (2020) e Vargas (2011). Partiu-se do fundamento teórico sobre a dignidade da pessoa humana, aponta-se a falência do sistema penitenciário pátrio, buscando apresentar dados concretos (DEPEN:2019) sobre a relação da educação e contribuição do método APAC para viabilização da reintegração social. |
| Abstract: | The present investigation is part of the Research Line “Theories of Education” of the Graduate Program in Education at the Pontifical Catholic University of Goiás. The object of study deals with the discussion about the contribution of education to the process of social reintegration of criminal egress, presenting the characteristic approaches on the application of the APAC method, officially established in the prison system of the State of Minas Gerais. This method has gained national and international prominence (Grossi: 2020) as an object of scientific study, due to the results achieved in prison management based on the humanization of punishment. As a main problem the place of education applied to the penal redemption institute is questioned by the study provided for in the Penal Execution Law (BRASIL: 1984), with a view to enabling the process of social reintegration of criminal egress. In an attempt to deepen the problem raised, the general objective of the work is to demonstrate the relationship between the penal execution system, the institute of penal redemption through study and the pedagogical theories of education; as specific objectives: To study the historical evolution of the dimensions of fundamental rights that constituted the consecration of the right to the dignity of the human person, and its relationship with Criminal Execution. Demonstrate a historical synthesis of the constitutionalization of the right to education, relating it to the institute of penal remission through the study. Present the APAC Method of prison management, its foundations, purposes and its insertion in the Plan State of Education of Minas Gerais. Discuss the theories of education foundations. Point out the inexistence of the APAC Method in the State of Goiás, to, at the end, demonstrate, through documentary and bibliographic research, the contribution of education and its relationship with the APAC method. For the construction of the work, a review of the literature on the theme of fundamental rights was used, using a related theoretical framework, with emphasis on: a) the fundamental right to education and the dignity of human personnel in Sarlet (2006), Carvalho (2008) and Silva (1999); b) The historical evolution of the state punitive system under Foucault (2004), Beccaria (1999), and Goffman (2015); c) Historical evolution of the constitutional norms that regulate education in Ribeiro (2009) and Piletti (2010) and its relationship with the criminal enforcement system, based on the current legal system and the vision of Torres (2019), Grossi (2020) ) and Alberto (2021); and d) Contributions of the APAC method in the prison system of the State of Minas (MINAS GERAIS, 2016), Ottoboni and Ferreira (2016), Grossi (2020) and Vargas (2011). Starting from the theoretical foundation on the dignity of the human person, the failure of the country's penitentiary system is pointed out, seeking to present concrete data (DEPEN:2019) on the relationship between education and the contribution of the APAC method to the viability of social reintegration. |
